NBME® Web-Based Testing Pre-Registration System DATA PRIVACY and SECURITY POLICY Effective January, 2010 The National Board of Medical Examiners (NBME) is committed to protecting your privacy and to maintaining the integrity and privacy of personal information that NBME collects through the NBME® Web-based Testing Pre-Registration System (“the System”). The following Privacy Policy (“Policy”) explains NBME’s information collection and dissemination practices in connection with the System and its use within the Roster Application (“Roster”). Please review the Policy and feel free to contact us at medicalschoolservices@nbme.org if you have any questions. If we change our Policy, we will post any changes on this webpage so that you are always aware of the information that we collect and how we use it. 1. Collection of and Consent to Use Personal Information from Roster When completing the fields accessible through the System, you may provide personal information to us. Personal information may include, but is not limited to: First Name Middle Name Last Name Suffix Date of birth Gender School ID Number Program Type School Start Date Expected Graduation Date Class Level By providing this information online, you consent to allow your school and NBME to use that information in accordance with this Policy. 2. Security Appropriate technical, physical and administrative safeguards have been implemented to help protect your personal information against unauthorized access or loss. To protect your privacy, the NBME utilizes Secure Sockets Layer (SSL) technology to prevent third parties from seeing your personal information during any data transmission. Access to information collected via the System is limited to those employees or agents of NBME or your medical school who have a need to access it and who are bound by confidentiality agreements. The NBME is committed to protecting your privacy and will only use the personal information collected via the System for the purposes described in this Privacy Policy. Should you still have concerns about the security of your personal information, please contact NBME or your medical school as detailed below, and we will try to accommodate your concerns. Unfortunately, no data transmission over the Internet can be guaranteed to be secure. As a result, while we strive to protect your personal information, we cannot and do not ensure or warrant the security of any information you transmit to us, and you do so at your own risk. In the event there is a breach of the security measures used by NBME, NBME will take reasonable and appropriate actions to minimize the damage resulting from the security breach. However, NBME cannot guarantee that unauthorized individuals will not obtain access to NBME systems through illegal measures, despite our security measures. If, for any reason, you should choose not to provide your personal information online, you may contact your medical school to determine how to proceed. 3. Purposes and Uses of Personal Information Collected The personal information collected via the System will be used in the Roster Appliication: (1) for web-based exam roster development; (2) to administer the examinations and verify your identity; (3) to score the examinations; (4) to identify and prevent testing fraud and maintain the integrity of the testing process by detecting and preventing test taking by unauthorized candidates; and/or (5) as required by law. 4. Disclosure of Personal Information Your personal information may be provided: (1) to your medical school; (2) to NBME; (3) to data processors who process the data, assist in exam administration, and who are bound by contracts to limit their use of the information to the purposes specified in this Policy; and (4) to third parties if required by law or as necessary to complete a testing fraud investigation directly related to the relevant candidate(s). We may also disclose your personal information to certain third parties in order to provide the products and services you have requested. Information is sent using secured protocols and encryption. They have access to the minimal information needed to perform their functions, but otherwise will not use the information for other purposes. NBME also shares certain user information with the Association of American Medical Colleges (the “AAMC”). This organization uses the data that we provide for research purposes only. Other than as noted in this Policy, or as NBME shall notify you in the future, NBME does not sell, rent, share, offer, or otherwise disclose any personal information, such as names, e- mail addresses, mailing addresses, telephone numbers, credit card information, and other personal information that you provide to NBME, to any organization or individual without a legitimate interest (collectively “Third Parties”), except to the extent necessary to comply with applicable laws or valid legal process, or to protect the rights or property of NBME. 5. Access and Ability to Correct Personal Data You may request changes to your name, date of birth, or school identification number through your school’s Registrars Office. 6. Children’s Privacy This System is not designed to be completed by children. Accordingly, we do not intend to collect personal information from anyone we know to be under 13 years of age. 7. Limitation of Liability Neither the NBME nor any of its subsidiaries or affiliate entities, agents, employees, or subcontractors will be liable for any direct, indirect, special, incidental, consequential, punitive, or exemplary damages, including lost profits (even if we are advised of the possibility) arising in any way from the information collected by the System or any information transmitted via the Roster Application project. The NBME is not liable for any damages or losses that may be caused to any equipment and other software due to any viruses, defects or malfunctions in connection with access or use of the System. 8. Commitment The NBME is committed to protecting your privacy. While we cannot guarantee privacy perfection, we will address any issue to the best of our abilities as soon as possible. 9. Inquiries and Concerns NBME reserves the right to change this Policy at any time by notifying users of the existence and location of the new or revised Privacy Policy. Your continued use of the System after notice of a change shall constitute your acceptance of any such changes to this policy.
